Insurance Legislation for Residential Fuel Oil Releases
Environmental consultants and LSPs have long recognized a divergence in what homeowners believe is covered under the homeowner's insurance policy and what the insurer considers a covered loss under "Pollutants". Where an average fuel oil cleanup can cost tens of thousands of dollars, and a cleanup with groundwater impact considerably more, this misconception often results in catastrophic personal financial loss for the homeowner. In order to provide some relief to homeowners, legislation has been adopted wherein all homeowner's insurers in MA must now offer cleanup coverage to homeowners upon inquiry, provided their heating system has been upgraded and certified. Most recently, homeowners have realized a backlash wherein if pollution coverage is not elected all pollution coverages are excluded from the standard homeowner's policy. Personal experience has shown that this optional $100,000/$300,000 coverage can be purchased for less than $100 per year. For more information on this new legislation please refer to New Insurance Legislation for Residential Fuel Oil Releases. For additional information on the upgrades required to receive such covereages please refer to Homeowner Oil Heating System Upgrade - Insurance Law. You may also contact our office directly with any questions or concerns regarding your fuel oil heating system.
Due Diligence Roadshow
BEA has developed a Due Diligence roadshow which has been presented to various financial institutions, real estate agencies and municipal agents. The presentation focuses on the Phase I Environmental Site Assessment as governed by ASTM E1527-05 and provides examples of what environmental professionals look for in these investigations. We are currently developing presentations on MA Endangered Species Act filings and the new EPA lead paint regulations as well. If you have interest in BEA providing such a presentation to you and your colleagues please contact Kara Risk directly.

Here are a few things you can do conserve water in the summertime:
- Regularly check pipes, hoses, valves and faucets for leaks.
- Use a pool cover to keep water clean and reduce evaporation.
- Use a bucket for washing. Keep a nozzle on the hose to save water. Use a commercial car wash the recycles water.
- Longer grass means less evaporation. Let grass grow taller in hot, dry weather. Set the mower one notch higher.
- Mulch your garden to slow evaporation.
- Deep soak weekly in the early AM or evening when the least evaporation occurs. Aerate lawn.
